Welcome to FableFleet. These Terms of Service (“Terms”) are an agreement between you and FableFleet (“FableFleet,” “we,” “us,” or “our”) and govern your use of our website and our personalized story service. By using our website or placing an order, you agree to these Terms. Please read them carefully.

Who may use the service

You must be at least the age of majority where you live to place an order. The service is intended for parents and guardians who create personalized stories for the children in their care. By providing information about a child, you confirm that you are the child's parent or legal guardian, or that you have the permission of the parent or guardian.

What we provide

FableFleet creates personalized bedtime stories and animated milestone stories (each, a “story”) based on the details and photo you provide. Each story is made to order for the specific child named in your order. Delivery timing is shown at the time of your order and may vary.

Your account and information

You are responsible for the accuracy of the information you provide, including names, spelling, and the photo you upload. Because each story is personalized, we rely on the information you give us to produce it. You are responsible for keeping your account details secure.

Content you provide

When you upload a photo or provide names and details, you keep ownership of what you provide. You grant us a limited license to use that content solely to create, deliver, and support your order, as described in our Privacy Policy. You confirm that you have the right to provide the photo and information, that it depicts your own child or a child for whom you have parental or guardian permission, and that it does not infringe anyone's rights. You agree not to upload content that is unlawful, harmful, or that you do not have the right to share.

The story you receive

When your order is complete and paid, you receive a personal license to view, download, and share the finished story for your own personal, non-commercial, family use. We retain ownership of the underlying artwork, characters, templates, music, and production elements, other than the personal details and photo you provided. You may not resell the story, use it commercially, or represent that you created the underlying artwork.

Pricing and payment

Prices are shown on our website in the currency indicated at checkout. We may change prices at any time, but changes will not affect orders you have already placed. Payment is processed securely by Stripe. By placing an order, you authorize us to charge the payment method you provide.

Refunds and cancellations

Because each story is personalized and made to order, our refund and cancellation terms are set out in our Refund Policy and our Cancellation Policy, which form part of these Terms. Please review them before ordering.

Acceptable use

You agree to use the website and service lawfully and not to interfere with its operation, attempt to gain unauthorized access, or misuse it in any way. We may suspend or end access for anyone who violates these Terms.

Availability and changes to the service

We work to keep the service available and running well, but we do not guarantee it will always be uninterrupted or error free. We may add, change, or discontinue features from time to time.

Disclaimers

The service is provided on an “as is” and “as available” basis. To the fullest extent permitted by law, we disclaim warranties that are not expressly stated in these Terms, including implied warranties of merchantability and fitness for a particular purpose.

Limitation of liability

To the fullest extent permitted by law, FableFleet will not be liable for any indirect, incidental, or consequential damages arising from your use of the service. Where liability cannot be excluded, our total liability to you for any claim relating to an order is limited to the amount you paid for that order.

Governing law

These Terms are governed by the laws of the Province of British Columbia and the federal laws of Canada that apply there, without regard to conflict of law rules. You agree that any dispute will be handled by the courts located in British Columbia, Canada.

Changes to these Terms

We may update these Terms from time to time. When we make material changes, we will update the effective date above. Your continued use of the service after an update means you accept the revised Terms.
